These Terms of Service ("Terms") govern your access to and use of Packetmail (the "Service"), operated by Packetmail ("we," "us," or "our"). By creating an account or otherwise using the Service, you agree to these Terms.
1. The Service
Packetmail is a transactional email and deliverability platform. We provide infrastructure, APIs, and an operator dashboard for sending email, tracking events, and managing recipient consent.
2. Your account
You must provide accurate registration information, keep credentials confidential, and notify us promptly of any unauthorised access. You are responsible for all activity on your account, including activity by team members you invite.
3. Acceptable use
You agree not to use Packetmail to send:
- Unsolicited bulk email or any message in violation of CAN-SPAM, GDPR, CASL, or any equivalent law in your jurisdiction.
- Content that is unlawful, defamatory, harassing, deceptive, or infringes the rights of others.
- Phishing, malware, fraud, or content designed to harm recipients or third parties.
- Mail to recipients on industry suppression lists or who have not given verifiable consent.
We may suspend or terminate accounts that breach these rules. We are not obligated to monitor traffic but reserve the right to investigate suspected abuse.
4. Plans and billing
Paid plans renew automatically until cancelled. Fees are billed in advance via Stripe and are non-refundable except where required by law. You can change or cancel your plan at any time from Settings → Billing; cancellation takes effect at the end of the current billing period. We may change pricing with at least 30 days' notice to your account email.
5. Service availability
We work to keep the Service available but do not guarantee uninterrupted access. We may perform maintenance, deploy updates, or temporarily disable features. Enterprise customers may have separate Service Level Agreements that supersede this section.
6. Your content
You retain all rights to the email content, recipient lists, and other data you submit ("Customer Data"). You grant us a limited licence to host, transmit, and process Customer Data solely to provide the Service. We do not sell, rent, or use Customer Data to train machine-learning models.
7. Termination
You may terminate your account at any time. We may suspend or terminate accounts for breach of these Terms, non-payment, or risk to platform integrity. On termination we will, where reasonably possible, provide an export of your data for at least 30 days before deletion.
8. Disclaimer of warranties
The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that emails will be delivered to any particular inbox.
9. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
10. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the version date at the top of this page and, for material changes, ask you to re-accept the Terms before continuing to use the Service.
